These terms and conditions of use for the BDnF site, whose address is http://bdnf.bnf.fr, (hereinafter referred to globally as “the Site”), define the terms and conditions of use for the Site by its users. By navigating within the Site, users indicate that they have read and agreed to the terms and conditions of use (hereinafter “the Terms”). The applicable Terms are those available on line on the Site on the day of users’ connection to it. The BnF reserves the right to modify the Terms at any time in order to adapt them to mandatory legal changes or to new features on the Site that could be proposed to users, and by publishing a new version on the Site. The date of the latest update of these Terms is indicated in the first line of the Terms themselves.

1. PURPOSE

The purpose of these Terms is to establish and regulate the ways in which the Site can be used by users.

2. TERMS AND CONDITIONS OF USE FOR THE SITE

The Site provides information pertaining to the BDnF App, and allows users to download it onto their computers (PC and Mac), tablets (iOS and Android) and, in a simplified version, mobile phones (iOS and Android). In addition, users may also:

  • - download teacher’s guides to learn about the conventions of comics.
  • - download image banks of elements (characters, settings, accessories, etc.) to complement the image banks and documents that come with the BDnF App.
  • - contact the BDnF team at the BnF (National Library of France) via the contact page, especially to send links to their creations in order to share them with the BdNF team.
  • - see, watch or download projects made by others via the BDnF App.
  • - be redirected toward the BnF’s institutional or commercial partners’ websites.

3. CONDITIONS OF ACCES TO THE SITE

Use of the Site requires an Internet connection, preferably a high-speed one. Users are hereby informed that this connection is not supplied by the BnF. Users can use the Site from a personal computer or any other mobile device (such as a tablet, mobile phone or other) that offers internet access.

4. USERS’ PROMISES AND RESPONSIBILITY

Users promise not to contravene either legislative regulations in effect or these Terms. Users are informed that any and all violations of the aforementioned regulations and Terms can lead to legal proceedings and sanctions against them. Users are hereby informed that the BnF reserves the right to block their access to the Site, immediately and without warning, if their use of the Site violates these Terms or, more generally, any laws or regulations in effect. As a general rule, the BnF can not be held responsible in the case of users using the App in ways that are not in accordance with the Terms.

5. PERSONAL DATA AND COOKIES

5.1 Personal data collected on the site directly from users

In order for users to enjoy the features of the Site, their personal data will be collected by the BnF. The data collected via the Site will be processed for administrative, statistical and usage-study purposes, under the auspices of the BnF. In accordance with the modified Personal Data Protection Act N° 78-17 of January 6, 1978, all users have a right to access and rectify their personal data, as well as the right to refuse, for legitimate reasons, to allow their data to be processed by the BnF. Consequently, users may demand that any personal data of theirs that is in the BnF’s possession be communicated to them, so that it can be corrected, completed, clarified, updated or erased. These rights may be enjoyed by users by contacting the BnF’s personal-data-protection delegate at the following address:dpd@bnf.fr and clearly specifying that they are exercising their rights as presented in the Terms of the http://bdnf.bnf.fr/ website. The BnF promises to implement and apply the safety measures it deems necessary in order to guarantee the confidentiality of personal data collected on the Site for the duration of its processing, in accordance with the abovementioned Personal Data Protection Act.

5.2 Data collected indirectly from Users of the Site (Cookies)

Trackers or cookies are installed automatically on users’ work stations when they connect to the Site. The cookies used by the BnF allow it to collect data about users for statistical and usage-study purposes. By continuing to use this Site, users agree that we will use those cookies about which they have been informed by a dedicated banner on the Site’s home page. Users are entitled to refuse the use of cookies by following the instructions provided below, as well as on the “find out more” page appearing in the aforementioned banner.

5.2.1 Configuring Users’ Browsers

Users have the option of configuring their navigator to accept or refuse all cookies, to delete cookies periodically, as well to see when a cookie has been issued, how long it will be valid, and its contents, and to refuse for it to be installed on their hard drive. 6.1 Intellectual-property rights pertaining to the Site

The BnF holds all intellectual-property rights pertaining to the Site. Users promise not to use the Site in any way that would constitute a violation or an infringement of applicable French laws and regulations.

6.2 Intellectual-property rights pertaining to the brands and logos

The BnF owns the verbal brands “BnF” and “BDnF” as well as the semi-figurative “BnF preceded by a curly bracket” that appears on the Site. The abovementioned brands have been registered by the BnF at the INPI and may not be used without express, prior written consent from the BnF. Any total or partial usage or apposition of these verbal, semi-figurative or figurative brands without express, prior written authorization will contravene article L. 716-1 of the Intellectual Property Code.

6.3 Intellectual-property rights pertaining to the contents of the Site

Certain contents of the Site (texts, images, sounds or other documents) are subject to intellectual-property rights. Consequently, reuse of those contents is controlled and subject to prior, written consent from the owners of the rights pertaining to this content, unless said reuse falls within the boundaries of exceptions to copyright established in Article L. 122-5 of the Intellectual Property Code or is subject to specific indications, see images bank details on the website of the Application.

7. GOVERNING LAW - DISPUTES

The Site and these Terms and Conditions of Use and Service are subject to French law. In case of dispute, French courts have jurisdiction.

In the event of conflict or inconsistency between the French and English versions of this contract, or of a challenge about the meaning of any of the terms or provisions included herein, the French version shall prevail

These terms and conditions of use of the desktop BDnF app, downloadable from https://bdnf.bnf.fr, and the mobile BDnF app (hereinafter referred to globally as “the App”), define the terms and conditions of use of the App by its users. By navigating within the App, users indicate that they have read and agreed to the terms and conditions of use (hereinafter “the Terms”). The applicable Terms are those available on line via the App on the day of users’ connection to it. The BnF reserves the right to modify the Terms at any time in order to adapt them to mandatory legal changes or to new features in the App that could be proposed to users, and by publishing a new version on the App. The date of the latest update of these Terms is indicated in the first line of the Terms themselves.

1. PURPOSE

The purpose of these Terms is to establish and regulate the ways in which the App can be used by users.

2. TERMS AND CONDITIONS OF SERVICE FOR THE APP

The App constitutes a digital creation tool that enables users to create their own digital comic, photo-novela, or other multimedia narrative combining illustrations and texts. In order to produce their creations, users work with various types of resources and collect them in order to compose their own library of elements or documents:

  • - elements (landscapes, people, objects, bubble shapes, typographies, and more) made available in the image editor
  • - images imported from Gallica, the BnF’s on-line digital library, the internet or elsewhere
  • - users’ creations imported from outside the App
  • - drawings users create themselves with the image editor

  • The image editor allows users to add or remove visual elements, and to apply effects and transformations (rotation, enlargement, reduction, color change). It integrates a clipping and cropping tool. The text editor allows users to write in the color of their choosing, as well as to choose their typeface and to apply the transformations listed above for the image editor. Above and beyond the comic-creation tool, the App aims to provide accompaniment for understanding the techniques (storyboarding, image-script) and history of comics, a unique form of expression. For this reason, a script-writing guide is integrated into the App. Users have the possibility of:
    • - Creating a profile by choosing a pseudonym (other than their actual first or last name).
    • - Searching for, creating, and/or importing resources (personal creations or other documents from outside sources (API Gallica, web or other).
    • - Choosing a format for their stories.
    • - Composing pages and frames.
    • - Modifying their resources (cropping, rotation, mirror effect, clipping) with the editing tool, which also makes it possible to add or delete visual elements (text and images) and apply transformations (e.g. rotation, enlargement, reduction), as well as to choose the typeface, case (upper or lower) and color of their text.
    • - Applying a graphic filter to the whole.
    • - Saving it locally, publish, print or share it (e-mail, social media, etc.).

    3. CONDITIONS OF ACCESS TO THE APP

    Using the App does not require an internet connection. Nonetheless, users need to first download and install the installation file in order to be able to work offline. The App is available for computer (PC and MAC), tablet (iOs and Androïd) and, in a simplified version (iOs and Androïd), cell phone. The App can be used off-line, but an internet connection enables users to use the search feature connected to the Gallica database.

    4. USERS’ PROMISES AND RESPONSIBILITY

Users are informed that any and all violations of the aforementioned regulations and Terms can lead to judicial proceedings and sanctions against them. As a general rule, the BnF can not be held responsible in the case of users using the App in ways that are not in accordance with the Terms.

    5. PERSONAL DATA AND COOKIES

    5.1 Personal data collected on the site directly from users

    The BnF does not receive any personal data without your consent, and does not share any with third parties.

    5.2 Data collected indirectly from users of the Site from (“Cookies”)

    Third-party (i.e. not the BnF) trackers or “cookies” are installed on the user’s terminal when they are connected to the App. These cookies are placed only by Unity, and they make it possible to record information about users for statistical purposes and usage studies in accordance with Unity’s confidentiality policy (link below). Unity collects users’ personal data, including, most notably, their IP address. Nonetheless, the BnF receives data about visitor usage collected by Unity on the App in anonymous form only. Users have the option of finding out more about and refusing data collection by Unity at any time by going to the “cookies” tab located on the App’s home page in the App’s drop-down menu. To opt out of collection of their data, users can click on the “request my data” button. The “cookies” tab also offers a link to Unity’s website and its confidentiality policy (https///unity3d.com/legal/do-not-sell-my-personal-information). To exercise their rights concerning their data collected, as well as for any other question about processing it, users are invited to contact Unity directly, since they are the ones in charge of data processing.

    7.1 Conditions of use for Gallica contents

    Reusing contents from the Gallica site, whether it is content already imported into the application or content that the user imports into the application himself, is regulated by the conditions of use of Gallica contents, accessible at the following address:http://gallica.bnf.fr/html/und/conditions-dutilisation-des-contenus-de-gallica. Users promise to respect those conditions of use for any reuse of what they create.

    7.2 Conditions of use for documents and/or elements imported from the internet or elsewhere

    Users may import documents and/or elements imported from online or elsewhere into the App in order to make a digital comic, tele-novela or other multimedia narrative combining illustrations and text, on condition that their reuse does not infringe on other persons’ intellectual-property rights (the expression “Intellectual property rights” refers here to any copyright, moral right, commercial brand, commercial appellation, patent, or commercial secret), the right to fair competition, the right to privacy, the right to publicity or to any other property right. The reuse of documents and/or elements imported from the internet or elsewhere in the App must not be illicit, prejudicial, threatening, injurious, criminal, defamatory, libelous, or blasphemous, nor may it be an invasion of privacy or constitute hate speech.

    The BnF can not be held responsible for use of these resources in ways that are not compliant with these Terms or with French laws and regulations.

    8. CONDITIONS OF USE OF CREATED COMICS

    The user will be able to reuse the comic created using the Application for commercial and non-commercial purposes, as long as they respect the intellectual property rights and the conditions of use for Gallica's contents mentioned above.
